On Tuesday, May 12, 2009, a quorum of 58 voters APPROVED :_) amending Article IX (Police Regulations) of its general bylaws to insert new Section 10 therein as follows: Section 10. No person shall smoke, ingest, or otherwise use or consume marijuana or tetrahydrocannabinol (as defined in G.L. c. 94C, sec. 1, as amended) while in or upon any street, sidewalk, public way, footway, passageway, stairs, bridge, park, playground, beach, recreation area, boat landing, public building, schoolhouse, school grounds, cemetery, parking lot, or any area owned by or under the control of the town; or in or upon any bus or other passenger conveyance operated by a common carrier; or in any place accessible to the public. The fine for violation of this by-law shall be three hundred dollars ($300) for each offense. Any penalty imposed under this bylaw shall be in addition to any civil penalty imposed under G.L. c. 94C, sec. 32L. NOTE: Under Ayer by-laws Section 2 Enforcement of By-Laws - The Non-Criminal Notice Form at the discretion of the enforcing agent, may be utilized as an alternative to initiating criminal proceedings for violations of any Town By-Laws or any rule or regulation of any Town officer, Board or Department, the violation of which is subject to a specific penalty and which is included in Appendix A. Since they are not amending Appendix A, enforcement may be by way of criminal complaint application. |
