The below was adopted by the City Council at its meeting on February 17, 2009
IN THE YEAR TWO THOUSAND EIGHT AN ORDINANCE REGULATING THE PUBLIC CONSUMPTION OF MARIJUANA OR TETRAHYDROCANNABINOL
Be it ordained by the City Council of the City of Lynn and by the authority of the same as follows, to wit:
SECTION 1:00 No person shall smoke, ingest, or otherwise use or consume marijuana or tetrahydrocannabinol (as defined in G.L. c. 94C, § 1, as amended) while in or upon any street, sidewalk, public way, footway, passageway, stairs, bridge, park, playground, beach, recreation area, boat landing, public building, schoolhouse, school grounds, cemetery, parking lot, or any area owned by or under the control of the City of Lynn; or in or upon any bus or other passenger conveyance operated by a common carrier; or in any place accessible to the public.
SECTION 2:00 The provisions of Section 1:00 may be enforced through any lawful means in law or in equity including, but not limited to, enforcement by noncriminal disposition pursuant to M.G.L. c. 40, § 21D, by an law enforcement agent, servant or employee. The fine for violation of this by-law shall be three hundred dollars ($300) for each offense. Any penalty imposed under this by-law shall be in addition to any civil penalty imposed under M.G.L. c. 94C, § 32L.
SECTION 3:00 All ordinances and parts of ordinances inconsistent herewith are hereby repealed.
SECTION 4:00 This Ordinance shall take effect thirty-one (31) days after its final approval as adopted and advertised. |
